Ownership of the Site; Agreement to the Terms of Use

These Terms and Conditions of Use (the 'Terms of Use') apply to the Schools-Online web site located at www.Schools-Online.co.uk, Schools-Online.net, Schools-Online.org and Schools-online.org.uk

The Site is the property of Education-Lincs Ltd. BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE SITE.

Education Lincs Ltd reserves the right to change, modify, add or remove portions of these Terms of Use at its discretion. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to any changes. As long as you comply with these Terms of Use, Education-Lincs Ltd grants you access to the site and use of the Site.

Permitted Use
Subject to these Terms of Use, Education Lincs Ltd hereby grants you the right to access and use the Schools-Online website editor to build an education establishment’s website. Unless otherwise agreed by Education Lincs Ltd, the Schools-Online website editor is only for educational establishments in the United Kingdom.

The Schools-Online website editor is only accessible to subscribing users by the use of a password. You agree not to attempt to bypass the password by any means including, but not restricted to, any automatic device or program or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the site or any content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site. You are entirely responsible for maintaining the confidentiality of your account information, including your password, and for any and all activity that occurs under your account. Education Lincs Ltd must be informed immediately of any unauthorised use of your account or password.

Content
All text, images, downloadable resources and other content that make up ‘Schools-Online’, including the computer code developed by Education Lincs Ltd (collectively, "Content") contained on the Site is owned, controlled or licensed by or to Education Lincs Ltd.

Reproduction License
Certain aspects of the site are downloadable resources intended to be printed out for training purposes. You are granted a license to reproduce these materials in sufficient quantities to perform the intended function.

The materials must not be modified in any way without prior agreement. The materials must not be distributed in any form other than by downloading directly from the Schools-Online web site.

Submission of content
You may submit text, images and other appropriate data as part of your own web site under these restrictions. The material published should not:

contain profanity, obscenity, other inappropriate language, images or other content that may be offensive to other users.
be false, inaccurate, fraudulent or in any way misleading.
make personal comments referring to individuals, organizations, religions, or ethnicities that could be deemed offensive to them.
publish personal details of an individual or organization without their permission.
infringe upon any copyright, patent, trademark or similar rights held by another party.
violate any law, statute or regulation.

     
It is the responsibility of the teacher, or other responsible adult as determined by the subscribing establishment, to ensure that the material published is suitable for publication.

Education Lincs Ltd reserves the right to review materials submitted and to remove any materials at its sole discretion. Continued breach of these guidelines will result in termination of the subscription.

Your data
The data that you use to build your establishment website including without limitation text, photos, images, music, audio, videos and other establishment owned data remains solely the property of the subscribing establishment.

Data Processing
Our Data Processing Addendum forms part of this Agreement.

Links to Third-Party Sites
Where appropriate we will provide Internet links to other web sites that may be used to support your activities. Education-Lincs Ltd has no control over these sites or their content. Education-Lincs Ltd cannot and does not guarantee, represent, or warrant that the content in these sites is accurate, legal, and/or inoffensive. You must make your own judgments about the suitability for use in your own circumstances.

Privacy and Disclosure of Information
We believe that your privacy, and the privacy of all our users, is important. Please review our Privacy Policy. Education-Lincs Ltd reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process, or governmental request or to edit, refuse to post, or to remove any information or materials, in whole or in part, in Education-Lincs Ltd’s sole discretion.

Privacy Policies
If applicable law requires, you must provide and make available to your End Users on Your Sites a legally compliant privacy policy. A template policy is provided as part of the service but it is your responsibility to ensure that this is amended to suit your own circumstances.

Cookies
A website built with Schools-Online does not use cookies for tracking or other non-essential purposes and will not require a cookie warning. It is your responsibility to ensure that any embedded code from a third party does not set tracking cookies unless you switch on the optional ‘cookie warning’ available in the site settings.

Contract length
By subscribing to a Schools-Online website you are agreeing to an initial 12 month contract. The contract will continue on a 12 month subscription basis unless you have given us notice by letter or email before the end of the current 12 month period.

Payment for the service.
We will issue invoices to you within three months of the end of the current subscription period. It is your responsibility to ensure the payment is made before a new subscription period starts. We reserve the right to suspend a subscription if payment is not made in a timely manner.

Domain names
As part of the service we will offer you a domain name, or you can transfer a domain name you own to us, and we will maintain that domain name registration for the period of your subscription. Should you terminate the contract the domain name will be transferred to a new provider subject to your subscription fees to our service not being in arrears.

Warranty Disclaimer
Education-Lincs Ltd does not guarantee that the schools-online website will be error-free or uninterrupted and cannot be held responsible for any outcomes that result from the site being unavailable at a particular time.

Limitation of Liability
UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO BREACH OF CONTRACT, OR NEGLIGENCE, WILL EDUCATION-LINCS LTD BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS) THAT ARISE OUT OF OR ARE RELATED TO YOUR USE OF THE Schools-Online.co.uk SITE. IN NO EVENT SHALL EDUCATION-LINCS LTD'S AGGREGATE LIABILITY TO YOU FOR ANY LOSS, DAMAGE, OR CLAIM RELATED TO OR ARISING OUT OF THE SCHOOLS-ONLINE SITE EXCEED THE TOTAL AMOUNTS, IF ANY, PAID BY YOU TO EDUCATION LINCS LTD FOR ACCESSING THIS SITE.

Indemnity
You agree to indemnify and hold Education Lincs Ltd, officers, directors, agents, and employees harmless from any liability to third parties, including reasonable solicitor/attorneys' fees, arising from or related to your breach of this Agreement, or the documents it incorporates by reference, or your violation of any law or the rights of a third party.
